TERMS AND CONDITIONS

ARTICLE 1: GENERAL
These terms apply to the formation, content, and fulfillment of all agreements between Imperium Sports and the member and are an inseparable part thereof.

Any deviations from these terms are only valid if confirmed in writing by Imperium Sports.

ARTICLE 2: MEMBERSHIP
Membership is requested by completing and truthfully signing the registration form, including a health declaration.

Imperium Sports reserves the right to reject applications without providing reasons.

Membership is strictly personal and non-transferable.

Members must notify Imperium Sports of any changes in personal details within 10 days via the change form.

By registering, the member acknowledges and accepts the house rules and general terms and conditions.

ARTICLE 3: RATES, PAYMENT, AND PRICE CHANGES
Rates are specified in the signed contract and may be adjusted annually.

Any price changes will be communicated at least 30 days in advance.

Promotions and discounts apply only within the indicated period and cannot be applied retroactively.

Payments must be made in advance via direct debit or prepayment.

Automatic payments will be deducted 2 weeks before the next term.

In case of a failed payment, an administrative fee of €10 will be charged.

If a payment is overdue by more than 30 days, Imperium Sports reserves the right to block the membership until the outstanding amount is fully paid.

No refunds are provided for missed training sessions, regardless of the reason.

ARTICLE 4: DURATION AND TERMINATION OF MEMBERSHIP
Membership is entered into for the agreed duration and will be automatically renewed for an indefinite period unless canceled in writing in due time.

Cancellation must be done via the Virtuagym application. Verbal cancellations and cancellations via email will not be accepted.

A notice period of one full subscription period applies to cancellations.

If a member cancels too late, the payment obligation remains in effect until the contract is officially terminated.

Early termination is only possible in the following cases:
- Physical incapacity, supported by a medical certificate.
- Relocation more than 30 kilometers away from the location, supported by proof.
- Work or study abroad, supported by an employer's statement.

No exceptions are made for financial circumstances.

A €50 administrative fee will be charged for early termination due to the above reasons.

ARTICLE 5: FACILITIES AND HOUSE RULES
Members have access to all facilities within the agreed terms.

Imperium Sports reserves the right to temporarily or permanently close facilities for maintenance, renovation, or other necessary reasons.

The use of a towel is mandatory during training sessions.

Members must return weights and equipment to their designated places after use.

Smoking, alcohol, and drug use are strictly prohibited in and around the facilities.

Imperium Sports reserves the right to immediately terminate membership without refund in the case of repeated inappropriate behavior.

ARTICLE 6: LIABILITY
Imperium Sports is not liable for loss, theft, or damage to personal belongings.

Participation in training sessions and use of facilities is at the member’s own risk.

Imperium Sports advises members to take out personal accident insurance.

ARTICLE 7: PRIVACY
Imperium Sports processes personal data in accordance with applicable privacy laws.

Surveillance cameras are used to enhance security.

ARTICLE 8: SPECIFIC TERMS FOR PRE-REGISTRATION AND DISCOUNTS
During pre-registration for a new Imperium Sports location, members can benefit from an exclusive founder’s discount. This discount applies only to members who specifically enroll for that new location, even though the membership grants access to other locations.

The founder’s discount is only valid for registrations made before the official opening date of the new location.

Membership is finalized and established as a one-year subscription starting one week before the opening date. There is no possibility to deviate from or cancel this without paying the full first-year membership fee.

By registering, the member agrees to the location-based nature of the discount. This means the discount is non-transferable to other locations or memberships.

ARTICLE 9: MONITORING AND PENALTIES FOR ABUSE
The founder’s discount is intended to encourage the use of the new location. Members who sign up with the founder’s discount must primarily use their membership at the location for which the discount was granted.

Definition of primary use: The member must register at least 75% of their visits at the new location within the first three months after opening.

Imperium Sports reserves the right to monitor membership usage based on access records. In cases of misuse, the member will be notified in writing.

Members who allow non-members to enter without proper registration or payment will be fined €156. The same applies to non-members using the facilities without registration.

Members with a comfort membership, which allows a maximum of two training sessions per week, who exceed this limit (e.g., by entering with other members), will also be fined €156 per violation. In cases of repeated misuse, Imperium Sports reserves the right to unilaterally terminate the membership without refund.
